Health Guarantee and Sales Contract
This agreement made this day of 20__, between Carol Dimino d/b/a/ Geisterwolfe Shepherds hereinafter known as Seller, and hereinafter known as buyer.
SECTION I - DESCRIPTION OF ANIMAL PAYMENT
For the sum of $ minus the deposit** ($ ) placed to hold puppy, the receipt of which is hereby acknowledged, Seller hereby sells and convey to Buyer, the following described canine:
Breed: German Shepherd Dog Date of Birth:
Color: Male Female
AKC # Online Pin:
Puppy shall not be possessed by Buyer until all monies have cleared.
**Deposit agreement is a separate document.
SECTION II - HEALTH
Purchase price shall include the following vaccinations:
Puppy Booster #1
Puppy Booster #2
Puppy Booster #3
A second health record with dates and vaccination stickers will be provided.
Buyer acknowledges that this dog is delivered in a healthy condition.
Buyer agrees to have the puppy checked by a licensed veterinarian within 72 hours of purchase to certify such health, thereby relieving Seller of any and all claims. Seller is not responsible for Buyer’s vet expenses after pup leaves Sellers possession. Seller guarantees against laming/crippling hip and elbow dysplasia and all life threatening genetic health issues for 24 months. If there is a problem with hips or elbows OFA testing should be done and submitted to Seller along with written statements with address and phone number of licensed veterinarian. If any other health problems arise within 24 months you must present proof from a licensed veterinarian before you will receive a replacement pup. Guarantee is null and void if cause is accidental or brought on by owner negligence. Buyer must provide proof in a veterinarian report of any such issues. Buyer will be granted a replacement pup if said dog should have any life threatening or crippling genetic condition as stated. The dog does not have to be returned in order to receive a replacement pup. If shipping is needed it will be the responsibility of the buyer to pay for shipping.
Buyer shall agree that puppy shall be kept on a high quality, species appropriate diet, with appropriate supplements if deemed advisable. Puppy shall be kept a good weight (not to heavy, not too thin - vet will be able to help you determine that if needed). Puppy shall not be taken on jogs, long runs or extreme hikes within its first year. Puppy should not be permitted to jump off furniture, over obstacles or go up and down stairs until the pup is older and his/her joints have developed and cannot be damaged by such activities. Puppy shall be kept inside as a house dog, not in an outdoor kennel or chained out EVER!!
Puppy shall be wormed on a regular schedule twice a year (Panacure or Safeguard are the recommended dewormer, unless tapeworms are an issue). If puppy is on heart worm medicine it may cover worming. Please talk to your vet if you are not sure about your pup's preventatives as some cover multiple things. Puppy shall be kept on a holistic vaccination schedule and will not be given more than the DHPP vaccination unless the Buyers region requires it for the safety of the pup. Rabies is recommended at 6 months of age and all vaccinations and other preventatives shall be given at 4 weeks apart so as not to overwhelm the immune system of the pup. Vaccines should not be given less than 3 years apart, except for the one year booster.
Due to the current studies on hip/elbow dysplasia Seller requires puppy stays intact for the first 18 to 24 months of its life. If puppy is spayed or neutered before that age it will make the hip/elbow dysplasia portion of this guarantee null and void. Seller does not require spay/neuter in young dogs, but does promote responsible ownership and that all things relevant to the pup/dog, be done in the best interest of said pup/dog.
SECTION III - NAME SPECIFICATION AND REGISTRATION
When registering your dog Buyer agrees to include the name GEISTERWOLFE in the name. E.g. - Geisterwolfe’s Dusty or Dusty Vom Haus Geisterwolfe.
Buyer understands that this pup is being sold with a limited AKC registration and agrees that this pup will not be bred and if the pup is bred without express and written permission from Seller there will be a $10,000.00 fine for an unlawful breeding and breaking the contract, hereinafter agreed upon.
SECTION IV - CARE
The Buyer promises to provide responsible care for this dog by providing proper nutrition, sanitary facilities, appropriate vaccinations with regular veterinary attention and including protection from hazards such as traffic, other animals, etc. The canine will be kept indoors as a part of the family, unless the dog is being trained as a police k-9 officer or other official duty. Also, while crate training is a perfectly acceptable practice and is encouraged, no pup or dog should be restrained in a crate for extended periods of time. If someone brings a pup into their home they should have a schedule which relieves the pup of being in the crate for more than 4 hours at a time with breaks in between to cover an average workday, then the pup should be out of the crate for several hours in a row. German Shepherd pups NEED, at the very least, basic obedience training, lots and lots of socialization and daily exercise. If you can not provide this then the puppy or dog should be returned to the Seller to be placed in a more breed appropriate home.
SECTION V - RESALE-REPOSSESSION
The Buyer agrees to notify Seller if he/she cannot or will not care for this dog any further, and agrees to give Geisterwolfe Shepherds right of first refusal to get said pup/dog back. UNDER NO CIRCUMSTANCES WILL THIS DOG BE SOLD TO ANOTHER INDIVIDUAL, OR GIVEN TO ANY PET SHOP, RESEARCH LABORATORY OR SIMILAR FACILITY. If said dog is sold or given away it will be a breach of this contract and will make the Buyer vulnerable to a lawsuit under this agreement. This contract is not transferrable under any circumstances. If the need occurs the Seller will have a say in another approved home of the Buyers choosing or expect the dog to be returned. Seller reserves the right to take the puppy back if Seller has reason to believe the puppy is not being cared for or is being abused.
SECTION VI - ENTIRE AGREEMENT
This agreement supersedes all others, either oral or in writing between the parties with respect to the purchase and sale of the above described canine and contains all of the covenants and understandings between the parties with respect to said subject. Any modification or change to this agreement must be agreed upon in writing by both the Buyer and Seller.
SECTION VII - SEVERABILITY
If any portion of this agreement is declared invalid, any remaining portion shall remain in force and effect as if it had been executed with the invalid portion eliminated. It is the intension of the parties that they would have executed this agreement without including any such portion, which may, for any reason be declared invalid.
SECTION VIII - GOVERNING LAW
If any legal actions are needed all court proceedings will be brought to Monroe County, Pennsylvania.
I, hereby certify that I have read this agreement and further certify that I fully understand and agree to its terms.
